Terms of Service
These Terms of Service ("Terms") govern your use of Bunky (the "Service"), operated by Jan Kralovič (trading as Bunky), Switzerland ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Who can use Bunky
You must be at least 18 years old and able to enter into a binding contract. Bunky is intended for adults (parents/guardians). Children do not create or hold accounts.
2. What Bunky is — and is not
Bunky is a shared, real-time "wiki" where separated or co-parenting adults keep a structured profile of their child(ren) (health, school, contacts, custody schedule, shared expenses, notes and tasks) and share it with the other parent.
Bunky is an organisational tool. It does not provide legal, medical, financial or other professional advice. The activity history and exports produced by the Service are convenience records; they are not certified, notarised or guaranteed to be tamper-proof or admissible as evidence in any court or proceeding. Do not rely on Bunky as your sole record for legal purposes.
3. Your account
You sign in via Google. You are responsible for keeping access to your account secure and for activity under your account. Notify us of any unauthorised use.
4. Shared family data & other people's information
Bunky works by sharing a child's profile between the parents in a family. When you add another parent, they can view and edit the shared information. When you enter information about a child or any other person (e.g. a doctor's contact details), you confirm that you are entitled to provide that information for this purpose.
If a parent is removed from a family or deletes their account, shared records they contributed are retained for the other parent and the child, with the departing parent's name anonymised, as described in our Privacy Policy (§7). A removed parent keeps read-only access for 30 days to export their data.
5. Acceptable use
You agree not to misuse the Service, including: entering unlawful content; harassing or harming others; attempting to access data outside your family; probing, scraping, or interfering with the Service or its security; or using the Service to violate anyone's rights.
6. Subscriptions & payments
Bunky offers a free trial of 30 days with no payment card required; nothing is charged automatically. After the trial, continued access to paid features requires a subscription.
Subscriptions are sold and processed by our Merchant of Record (payment provider), who is the seller of record and handles payment and applicable taxes/VAT for your country. Prices are shown before purchase (currently €3.90 per month). You can cancel at any time; access continues until the end of the paid period. Statutory consumer withdrawal/refund rights, where they apply to you, are unaffected.
Purchases are made on the web. Where the app is distributed through an app store, in-app purchasing may not be available and you may be directed to manage your plan on the web.
7. Intellectual property
The Service, its software, design and branding are owned by us or our licensors. You retain your rights in the content you enter; you grant us the limited rights needed to host, process and display it to your family in order to operate the Service.
8. Disclaimers & limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of data beyond our reasonable control. Nothing in these Terms limits liability that cannot be limited under applicable law (including mandatory consumer protection).
9. Termination & account deletion
You may stop using the Service and delete your account at any time (see the Account Deletion page). We may suspend or terminate access for breach of these Terms or to comply with law. Provisions that by their nature should survive termination will survive.
10. Changes
We may update these Terms. Material changes will be indicated by updating the "Last updated" date and, where appropriate, by notice in the app. Continued use after changes means you accept them.
11. Governing law
These Terms are governed by the laws of Switzerland, without prejudice to any mandatory consumer-protection rights you have in your country of residence. Place of jurisdiction is Horgen (Canton of Zürich), Switzerland, subject to any mandatory venue rules that protect you as a consumer.
